Own an Empty Property? Important New Rules Are Coming

New legislation taking effect on 5 November 2026 could have implications for owners of long-term empty properties across Essex.

The Government has confirmed changes to the rules surrounding empty homes, reducing the period a property must remain unoccupied before a local council can seek an Empty Dwelling Management Order (EDMO) from two years to just six months.

But what does this actually mean for homeowners?

Can the Council Take Over Your Property?

Under the new rules, local authorities will be able to apply to take over the management of certain properties that have remained empty for six months or longer, with the aim of bringing them back into use.

Importantly, this does not mean the council can automatically seize your home or take ownership of it. There is a formal legal process, and the property owner retains ownership.

There are also important exemptions, including properties that are genuinely being marketed for sale or rent.

Is Now the Time to Consider Selling?

There are many reasons why a property might be sitting empty. Perhaps you’ve inherited a home, moved elsewhere, or simply haven’t decided what to do with a property you own.

With these changes approaching, now could be a sensible time to review your options.

At Stephen Lane Estate Agents, we can help you understand what your property might achieve on today’s market and discuss whether selling could be the right decision for you.
